29 CFR 1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and for preventing unauthorized personnel from attempting a rescue; a. Buckeye Ready-Mix, LLC located in Marion, Ohio: On or about February 28, 2018, the employer did not evaluate the designated emergency services ability to respond to a rescue summons in a timely manner and evaluate the rescue service's ability to rescue entrants from a particular permit space. Employees were performing oxy-acetylene torching and welding inside of aggregate bins #2, #3, #4, and #5 and the employer had not notified or evaluated the fire departments ability to respond for a rescue.
