Text For Citation: 01 Item/Group: 007A Hazard:
29 CFR 1910.146(c)(4): When the employer decided that its employees would enter permit spaces, the employer did not develop and implement a written permit space entry program that complied with 29 CFR 1910.146: a) On or about April 28, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, required employees to enter permit spaces, but had not developed and implemented a written permit space entry program that complied with 29 CFR 1910.146. Employees were required to enter permit spaces to perform maintenance work on actively moving or energized tensioning systems in the top and bottom housings of chair lifts including, but not limited to, the American Flyer and the American Eagle. These spaces were approximately 3 feet high, 20 feet wide, 40 feet long, located in between the work platform and the underside of the lift housings, and contained large fly-wheels and tensioning carriages. Employees were exposed to caught-in hazards during entry into these permit spaces when drive and tensioning components were moving or energized and capable of moving.
