29 CFR 1910.178(l)(4)(ii)(B): Refresher training, including an evaluation of the effectiveness of that training, was not conducted as required by paragraph (l)(4)(ii) when the operator had been involved in an accident or near-miss incident to ensure that the operator had the knowledge and skills needed to operate the powered industrial truck safely. On or about August 14th, 2024, employees engaged in material handling operations at the commercial bakery facility located at 4651 F Street, Omaha, Nebraska 68117 were exposed to struck-by hazards in that an employee, who was involved in an accident on August 8, 2024 while operating a Raymond Stand-up counter balanced lift truck (serial # 425-16-48663), did not receive refresher training as required in this subpart prior to operating a forklift again on August 9, 2024.
