29 CFR 1926.1127(d)(1)(i): The employer did not establish the applicability of this standard by determining whether cadmium was present in the work place and whether there was the possibility that employee exposure will be at or above the action level prior to performance of any construction work: a. On or about August 4, 2016, and at times prior to, at the power plant, the employer did not establish the applicability of the standard, did not determine that cadmium was present in paint-primer on turbine parts including but not limited to servo motors, and did not determine whether there was the possibility that employee exposures would be at or above the cadmium action level during manual scraping and chemical stripping of painted metal parts.
