29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Worksite, Mechanic Shop - Employees who performed routine maintenance activities on vans and buses worked with hazardous chemicals such as, but not limited to Permatex Battery Protector & Sealer, Product # 80370 (containing Xylene, Acetone and Ethyl Benzene); and CRC QD Electronic Cleaner, Product # 05101 (containing Naptha, Difluoroethane and Dimethylbutane). The employer did not have a written hazard communications program developed or implemented at the workplace on, or about March 13, 2015. Note: In addition to abatement certification, the employer is required to submit abatement documentation for this violation, in accordance with 29 CFR 1903.19. Failure to comply may result in an additional penalty of $1,000.
