29 CFR 1910.119(e)(3)(v): The employer did not always ensure the process hazard analysis addressed facility siting: ALON USA, LP, 200 Refinery Road, Big Spring, TX. The employer does not consider all of the occupied structures, including some with full-time occupancy, when it evaluates facility siting in the Process Hazard Analysis (PHS). This violation was observed on or about April 15, 2009, including, but not limited to the following areas: a) SCOT Motor Control Center, located approximately 35 feet south of the Sour Water Stripper and #2 SCOT Sulfur Recovery Units. b) Motor Control Center (MCC), located approximately 35 feet south of the Sour Water Stripper and #2 SCOT Sulfur Recovery Units. c) DCS, located approximately 35 feet south of the Sour Water Stripper and #2 SCOT Sulfur Recover Units. d) Warehouse, located approximately 35 feet south of the Sour Water Stripper and #2 SCOT Sulfur Recovery Units. e) Analytical Shelters, located within the Sour Water Stripper, #2 SCOT Recovery Unit, #2 Sulfur Recovery Unit, #1 SCOT Recovery Unit and #1 SCOT Sulfur Unit. f) General Warehouse, located southwest of the Crude / Vacuum / PDA Units. g) Motor Control Centers (MCC's) located south of the Low Sulfur Gasoline Unit (LSG). Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking in the workplace to ensure the process hazard analysis addressed facility siting.y
