Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: ANSI/SIA A92.9-1993, Paragraph 7.4.3: Before use each day or at the beginning of each shift, the Mast Climbing Work Platform was not visually inspected and functional test was not performed that included but not limited to the following: a)Operation and emergency controls, including but not limited to brakes, and limit devices. b)Safety devices. c)Air, hydraulic and fuel system leaks. d)Cables and wiring harness. e)Loose or missing parts. f)Tires and wheels. g)Placards, warnings, and control markings. h)Outtriggers, stabilizers, and other structures. i)Guardrail System. j)Mast guards. k)Mast sections. l)Attachments. m)Platform extensions. n)Items specified by the manufacturer. o)Correction of all malfunctions and problems identified and further inspection of necessary, before continued use. ANSI/SIA A92.9 -1993, Parrafo 7.4.3: Antes de cada dia de trabajo o al principio la jornada de trabajo, la Plataforma de Trabajo no fue inspeccionada visualmente y una prueba funcional no fue realizada, la misma tenia que incluir pero no tenia que limitarse a los siguientes: a)Los controles de Operacion y emergencia, inclusive pero no limitado a frenos, y a dispositivos de limite. b)Dispositivos de Seguridad. c)Aire, hidraulico y filtraciones de sistema de combustible. d)Cables y alambrar arreos. e)Afloja o partes perdidas. f)Llantas y ruedas. g)Pancartas, las advertencias, y marcas de control. h)Los estabilizadores, y otras estructuras. i)Sistema de Baranda. j)Guardias de la Plataforma. k)Secciones de la Plataforma. l)Dispositivos adicionales. m)Extensiones de Plataforma. n)Articulos especificados por el fabricante. o)Correccion de todas fallas de funcionamiento y problemas identificados e inspecciones adicionales de ser necesario, antes de continuar con su uso. At the Atlantis Construction Proyect at the facade located in the back side of the building. There was a mast scaffold used by employees for reaching the 18th floor were they were plastering exterior walls. The scaffold platform was at approximately 150 feet of height when another employee went to provide maintenance to the scaffold. The maintenance work consisted in changing one of the wheels that maintained elevated the platform. Meanwhile the plasterers kept working while the mechanic was repairing the scaffold. The scaffold Trademark was Hek, model MS Pro Max. It was a rainy day with strong winds when the mechanic took off the wheel to replace it with a new one. At this moment the scaffold platform came down in a free fall and the plasterers inside theplatform died. The employer did not assure that the users inspected and tested the platform before each use as specified on ANSI A92-1993 paragraph 7.4.3. Hazard: Scaffold failure, breaks or fell while employees were using it. En el Proyecto de construccion Atlantis, en la parte posterior del edificio habia un andamio de mastil que era usado por albaniles para poder alcanzar la pared exterior del piso 18 donde los albaniles se encontraban empanetando. La plataforma del andamio de mastil se encontraban a una altura aproximada de 150 pies cuando otro empleado fue a realizar trabajos de mantenimiento al andamio. El trabajo de mantenimiento consistia en cambiar una de las ruedas que mantenia la plataforma elevada. Los albaniles se mantuvieron trabajando mientras el mecanico se encontraba reparando el andamio. El andamio era marca Hek, Modelo MS Pro Max. El dia estaba lluvioso con vientos fuertes al momento que el mecanico saco la rueda para remplazarla por una nueva. En ese momento el andamio cayo en caida libre y los albaniles en la plataforma murieron. El patrono no se aseguro de que los usuarios inspeccionaran y probaran la plataforma antes de cada uso como se requiere en el ANSI A92-1993 parrafo 7.4.3. Riesgo: Andamio falle, se rompa o caiga mientras empleados lo estubiesen usando.sen
