29 CFR 1926.451(f)(4): Any part of a scaffold damaged or weakened such that its strength is less than that required by paragraph (a) of this section shall be immediately repaired or replaced, braced to meet those provisions, or removed from service until repaired. a) The employer does not ensure that the supported tubular welded frame scaffold on site is undamaged and structurally sound. This continuing violation was most recently observed at 1348 Bainbridge St., Philadelphia, PA 19147 on December 13, 2022, when employees performing stucco activities were utilizing a scaffold where three crossbraces were not connected to the scaffold frame maintaining four points of contact and were only partially secured to the scaffold frame. The employer's ongoing obligation is to ensure that all tubular welded frame scaffolding is fully constructed and safe for employees.
