29 CFR 1910.1053(i)(1)(i):The employer did not make medical surveillance available at no cost to each employee, and at a reasonable time and place, for each employee who has been occupationally exposed to respirable crystalline silica at or above the action level for 30 or more days per year: On or about February 8, 2022, the employer did not make medical surveillance available at no cost to each employer who was exposed to respirable crystalline silica at or above the action level for 30 or more days per year. a.) On or about February 8, 2022, the employer did not ensure that employees working at the 80T-1 Press were not exposed to levels of respirable silica at or above the action level. An employee working primarily on press 80T-1, was exposed to 31.62 ug/m3 of respirable crystalline silica over a sampling period of 428 minutes, approximately 1.26 times the action limit. Exposure calculations included a zero increment for the time not sampled.
