29 CFR 1910.1025(j)(1)(i): A medical surveillance program was not instituted for all employee(s) who were, or could be exposed to lead above the action level for more that thirty days per year: a. Rear Yard, Ferrous Metal Scrap Burn Area - The employer did not institute a medical surveillance program for an employee who was exposed to airborne concentrations of inorganic lead that exceeded the OSHA Permissible Exposure Limit. An employee was exposed to inorganic lead above the OSHA Permissible Exposure Limit (PEL). An employee, who was performing torch burning of metal scrap, was exposed to 8-hour Time Weighted Average (TWA) of 0.08550 milligrams per cubic meter of airborne lead during a 384 minutes occupational exposure. The 8-hour TWA employee exposure was 17.1times the OSHA Permissible Exposure Limit (PEL) of 0.050 milligrams per cubic meter. This violation was noted on March 7, 2019.
