29 CFR 1910.1052(j)(1)(i): The employer did not make medical surveillance available for employees who were or potentially were exposed to methylene chloride at or above the action level on 30 or more days per year, or above the 8-hour time weighted average permissible exposure limit or the short term exposure limit on 10 or more days per year: (a) On and before 02/08/2017, throughout spray area, for the employee wearing a dust mask while spraying duct work with adhesive containing ingredients such as, but not limited to, methylene chloride. Employee was exposed to methylene chloride at a short term exposure limit (STEL) of 178.740 ppm which has a severity of approximately 1.43 times the short term exposure limit (STEL) of 125.000 ppm. The sample was taken over a 15-minute period. The employer did not provide medical surveillance for methylene chloride.
