29 CFR 1926.1101(j)(2): The hygiene facilities and practices listed in sections (i) through (v) of this paragraph were not followed for employees performing Class I work involving less than 25 linear or 10 square feet of TSI or surfacing ACM and PACM, and for Class II and Class III asbestos work operations where exposures exceed a PEL or where there is no negative exposure assessment produced before the operation: a) On or about April 20, 2015, Local Roofing Co., Inc. did not provide decontamination facilities required by 29 CFR 1926.1101(j)(2) for employees performing cutting and cleanup of asbestos containing material when no negative exposure assessment had been conducted. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
