Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries and/or amputations in that: (a)The DI-ACRO 14-40-2 press brake, Serial No. JD-1260, had a 3" x 3" foot pedal that was not guarded to prevent accidental actuation, on or about August 4, 2005. (b)The Cincinnati mechanical press brake, with a 12' ram, had two foot pedals that were not guarded to prevent accidental actuation, on or about August 4, 2005. (c)The Niagara mechanical shear, with a 12' ram, had a foot pedal that was not guarded to prevent accidental actuation, on or about August 4, 2005. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT Instances a and b above is to protect the foot control in accordance with ANSI B11.3, safety requirements for the construction, care, and use of power press brakes, Section 4.3.4.3, so as to inhibit accidental actuation by falling or moving objects, or by someone stepping on it. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT Instance c is to protect the foot-operated tripping control in accordance with ANSI B11.4, safety requirements for the construction, care, and use of shears, Section 4.3.1.1, so as to prevent accidental actuation by falling or moving objects, or by someone accidentally stepping on them.
