29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets. On or about February 2, 2024, the employer failed to train employees on the company's Hazard Communication (HAZCOM) program and the different chemical hazards found in their workplace. Employees working on the automatic line load, pour, and smooth out the concrete material onto the molds to create the concrete product including but not limited to white portland cement type I-II, portland cement, Arcosa Lightweight--Expanded Shale Lightweight Aggregate, ConAir, and NiroCast K which contain chemicals including but not limited to calcium oxide, crystalline silica, sulfonic acids C14-16-alkane hydroxy C14-16 alkene sodium salts, sodium hydroxide, nitrocalcite tetrahydrate, and sodium rhodanate which can cause serious eye injury, chemical burns, and respirable hazards to employees who make contact with the chemical products.
