29 CFR 1910.1026(m)(4)(iii): Medical surveillance. The employer shall ensure that medical records are maintained and made available in accordance with 29 CFR 1910.1020. a.) On or about November 27, 2023, January 17, 2024, and February 7, 2024, the employer did not maintain and make available (upon request) to the Secretary the medical records containing the PLHCP's written medical opinion for annual physicals conducted in 2021 for welders included in the employer's medical surveillance program for exposure to hexavalent chromium.
