OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)Loading dock at 221 W. 38th St On or about September 18, 201 An employee used a Snorkel platform lift and he was not trained, thoroughly familiar with the Operations and Maintenance Manual and in the Training Responsibilities in ASNI 92.3-1990 Manually Propelled Elevating Aerial platforms. Among other methods, one feasible and acceptable method to correct this hazard is to comply with the manufacturer's (Traveler's) recommendation "Training is vitally important and MUST be carefully supervised by a skilled, responsible party. Training MUST include a thorough review of this manual and the "Traveler" machine..."." and ANS1/S1A: 92.3-1990 American National Standard for Manually Propelled Elevating Work Platforms, sections 6, 7 and 8
