29 CFR 1910.140(c)(13)(ii): Anchorages were not designed, installed, and used, under the supervision of qualified person, as part of a complete personal fall protection system that maintains a safety factor of at least two: a) On or about April 28, 2025, and at times prior, the employer, Powdr - Copper Mountain LLC DBA Copper Mountain Resort, did not ensure structures used as anchorage points on chair lift towers and catwalk platforms were designed, installed, and used under the supervision of a qualified person during maintenance work. Employees were required to climb chair lift support towers and access catwalks to perform maintenance operations on chair lifts including, but not limited to, the American Flyer, the American Eagle, and the Kokomo Express. During these operations, employees were positioned at heights greater than 4 feet from the lower ground surface level and used cross-member supports and guardrails as anchorage points and part of a system to prevent fall injuries. These anchorage points were not designed to be part of a complete personal fall protection system that maintained a safety factor of at least two. This condition exposed employees to fall hazards.
