29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a)Protective Coating Specialists, Inc. at 1350 7th Street Northwest, Huron, SD 57350: On or about and at times prior to December 4, 2023, the employer did not ensure that employees required to utilize respiratory protection were protected from hazards related to use of respiratory protection in that the company by completing a medical evaluation before being required to use a respirator in the workplace. This condition exposed employees to hazards related to use of respiratory protection.
