29 CFR 1910.1053(f)(1): The employer did not use engineering and work practice controls to reduce and maintain employee exposure to respirable crystalline silica to or below the PEL, unless the employer can demonstrate that such controls are not feasible: a.) On or about November 29, 2023, and at times prior, the employer did not have sufficient engineering controls where employees were exposed to respirable crystalline silica above the action level and OSHA PEL. OSHA conducted personal exposure sampling on November 29, 2023 and found three employees exposed to an 8-hour Time-Weighted Average of 349.5 - 373 milligrams per cubic meter of respirable crystalline silica, above the Action Level of 0.025 milligrams per cubic meter (or 25 micrograms per cubic meter). The employees use recycled water while saw cutting brick, but the water usage is not sufficient enough to bring the exposure levels below the OSHA PEL and action level.
