29 CFR 1910.215(b)(9): The distance between the abrasive wheel periphery(s) and the adjustable tongue or the end of the safety guard peripheral member at the top exceeded one fourth inch: a) Machine shop back wall: The distance between the wheel periphery and the top of the grinding wheel on the left side of a Baldor bench grinder, model 7307, measured 1 1/4 inches and there was no tongue guard in place, on or about 9/19/17. b) Machine shop back wall: The distance between the wheel periphery and the top of the grinding wheel on the right side of a Baldor bench grinder, model 7307, measured 1 1/2 inches and there was no tongue guard in place, on or about 9/19/17. c) Machine shop back wall: The distance between the wheel periphery and the top of the grinding wheel on the right side of a Baldor bench grinder, model 712 serial number H286, measured 1 inch and there was no tongue guard in place, on or about 9/19/17. d) Machine shop back wall: The distance between the wheel periphery and the top of the grinding wheel on the left side of a Baldor bench grinder, model 712 serial number H286, measured 3/4 inches and there was no tongue guard in place, on or about 9/19/17. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
