29 CFR 1910.1027(c): The employer did not ensure that no employee was exposed to an airborne concentration of cadmium in excess of five micrograms per cubic meter of air (5ug/m3), calculated as an eight-hour time-weighted average (TWA): Employees were exposed to cadmium at concentrations greater than the OSHA permissible exposure limit (PEL) of five micrograms per cubic meter (5 ug/m3) of air averaged over an eight-hour period; (1) On or about May 16, 2013, a Battery Break employee operating the skid steer was exposed to an 8-hour time weighted average (TWA) level of 8.83 ug/m3 of cadmium, which is 1.77 times the OSHA permissible exposure level (PEL) of 5 ug/m3. (2) On or about May 16, 2013, a Battery Break employee at the lower saw location was exposed to an 8-hour time weighted average (TWA) level of 9.54 ug/m3 of cadmium, which is 1.91 times the OSHA permissible exposure level (PEL) of 5 ug/m3. (3) On or about May 16, 2013, the charge floor employee was exposed to an 8-hour time weighted average (TWA) level of 20.75 ug/m3 of cadmium, which is 4.15 times the OSHA permissible exposure level (PEL) of 5 ug/m3. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
