29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria for labels and other forms of warning, safety data sheets, and employee information and training will be met. On or about February 2, 2024, the employer failed to develop and maintain a written Hazard Communication (HAZCOM) program for employees working on the Automatic Line when employees load, pour, and smooth out the material onto the molds for the concrete mixture. The concrete mixture contained several products that were labelled as corrosives and respirable hazards and identified as being able to cause serious chemical burns and eye damage, including products such as white portland cement type I-II, portland cement, Arcosa Lightweight--Expanded Shale Lightweight Aggregate, ConAir, and NiroCast K which contain products including but also not limited to calcium oxide, crystalline silica, sulfonic acids C14-16-alkane hydroxy C14-16 alkene sodium salts, sodium hydroxide, nitrocalcite tetrahydrate, and sodium rhodanate.
