29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l): 29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) AND AS REFERENCED BY THE NOTE CONTAINED IN 1926.602(d). On or about May 19, 2023, a forklift operator was moving material to the roof of an apartment building under construction without receiving training, exposing employees to struck-by hazards.
