29 CFR 1910.28(b)(1)(i): Except as provided elsewhere in 29 CFR 1910.28, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by one or more of the systems described in 29 CFR 1910.28(b)(1)(i)(A)-(C): (a) Mixing Department, Upper roof: On or about February 23, 2022 and times prior, an employee performing weekly, routine monitoring of the roof mounted Lines 13, and 1 -6 dust collectors was exposed to a fall hazard greater than 4 feet while using a fixed industrial stair system at the Northwest corner of the roof associated with the carbon black tower. The fixed industrial stair systems placement exposed employees to an unguarded roof edge near the stair system along the North edge of the roof. (b) Mixing Department, Joint Venture roof: On or about February 23, 2022 and times prior, an employee performing weekly, routine monitoring of the roof mounted Lines 7 - 12 dust collectors was exposed to a fall hazard greater than 4 feet while using a door to a stairwell access between the building and the roof. The placement of the access door exposed employees to an unguarded roof edge near the stair system along the West edge of the roof. (c) Mixing Department, Line 6 (Floor 1): On or about February 24, 2022, an employee performing servicing and maintenance on the Line 6 Festoon was exposed to a fall hazard greater than 4 feet while working at the end of an open sided elevated work platform at the West end of the machine without a fall protection system in place.
