29 CFR 1926.652(b)(2): Maximum allowable slopes, and allowable configurations for sloping and benching systems, was not determined in accordance with the conditions and requirements set forth in Appendices A and B to this subpart. Instance 1. On or about November 5, 2019, and at times prior thereto, employees were building the rock wall in the excavation for the North wall of the detention pond. Employees worked within a few feet of the 15 foot high, near vertical, cut in the class B soil without adequate means to prevent soil collapse. Instance 2. On or about November 5, 2019, and at times prior thereto, employees were removing form wood from the concrete wall in the excavation on the West end of the detention pond without the use of cave-in protection, exposing employees to being crushed between the concrete form wall and collapsing soil from the 17 foot high, near vertical, cut in the class B soil.
