Text For Citation: 01 Item/Group: 006A Hazard:
29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training were met: a) 3 Terminal Road, New Brunswick, NJ - Tablet Press/Encapsulation Department and Warehouse Employees in the Encapsulation Department worked with explosive ingredients, such as but not limited to powdered mixtures containing whey protein concentrate, which accumulated on the floors and on machine surfaces during the encapsulation process. The employer did not develop, implement or maintain a written hazard communication program to assess, determine and classify the physical hazards of the accumulating dusts. Dusts collected in the area had explosion severities ranging from 0.05 to 1.81 and Kst values ranging from 2.29 to 22.72. Employees in the warehouse also worked with hazardous chemicals, such as but not limited to caustic soda micropearls containing sodium hydroxide (98%) to clean coating pans, without the employer having a written hazard communication program in place. Condition observed on or about 3/15/2019. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
