29 CFR 1910.120(q)(8): Employees trained in accordance with paragraph (q)(6) of this section did not receive annual refresher training of sufficient content and duration to maintain their competencies, or did not demonstrate competency in those areas at least annually: a) Establishment - Approximately three of the twenty four members of the facilitys Emergency Response Team had not received their annual 8 hour HAZWOPER refresher training. One of the employees who had not received the 8 hour refresher training responded to the explosion that occurred on 7/11/14. On or about 7/21/14. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
