29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. Location: 42 West Street, Brooklyn, NY. 5th level roof elevator shaft. a) The floor hole/demolished stairwell shaft on the 5th floor was not protected by use of guardrails or other fall protection system. The shaft was used to hoist construction materials such as blocks and sand. An employee fell down the shaft while working near the shaft. On or about 09/25/2012. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY of 1,000.00, IN ACCORDANCE WITH 29 CFR 1903.19.
