North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the struck-by hazard due to unsafe hoist operation resulting from inappropriate procedures being utilized: a)facility, yard - employees attached the hooks for the slings of an electric powered hoist to a boat, which weighed approximately 3,000 pounds, by means of the bow and stern eyes on the boat rather than using the readily available slings, placed across the bottom of the hull to support the weight of the boat. On 10/07/09, this condition resulted in an accident in which an employee received fatal injuries when the port stern eye broke and the load became partially disengaged from the hoist. ABATEMENT NOTE: 1)Among other methods, one feasible and acceptable abatement method to correct these hazards is to not use the bow and stern eyes for lift, but rather use other means available, such as the electric hoist with slings across the bottom of the hull, the boat forklift, or yard arms to lift the boat.
