Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment wh ich were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the haz ard of rolling over equipment, or sudden impact with a fixed object resulting in the employee being ejected from the operators station: (a) On or about April 27 , 2005, furnace area, the operator of the Nissan forklift was not wearing the se at belt that was provided on the lift. (b) On or about May 2, 2005, small castin g area, the operator of the Nissan forklift was not wearing the seat belt that w as provided on the lift.
