North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to risk of fire or explosion in that: a)buffing area- compressed air was used to clean up combustible dust accumulation in the presence of several of ignition sources. Abatement Note: One feasible abatement method is to periodically cleanup dusts by using conductive, non-sparking scoops and soft brooms, brushes that have natural fiber bristles, or vacuum-cleaning devices designed for handling combustible metal dust. Compressed air can only be used in certain areas that are otherwise impossible to clean and, where permitted, shall be performed under carefully controlled conditions with all potential ignition sources prohibited in or near the area and with all equipment shut down.
