29 CFR 1910.1026(k)(1)(i)(A): The employer did not make medical surveillance available for all employees who were or could be occupationally exposed to chromium (VI) at or above the action level for 30 or more days a year: On or about April 10, 2024, the employer did not institute a medical surveillance program for employees who were exposed to chromium (VI) above the action level of 0.0025 mg/m3 for more than 30 days per year. Employee exposure was determined to be 0.016 mg/m3 as an 8 hour time weighted average.
