29 CFR 1926.62(i)(4)(iv): The employer did not ensure that employees did not enter lunchroom facilities or eating areas with protective work clothing or equipment unless surface lead dust had been removed by vacuuming, downdraft booth, or other cleaning method that limited the dispersion of lead dust: (a) On or about 05/01/2024 at the MTA-F line a 2.10-mile-long elevated steel structure from Kings Highway above McDonald Ave/Shell Road/West 6th Street and West 8th Street. Abrasive blasters were permitted to enter eating areas with contaminated half-face respirators and clothing which had been worn inside the containment during abrasive blasting. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.
