29 CFR 1926.701(b): All protruding reinforcing steel, onto and/or into which employees could fall, was not guarded to eliminate the hazard of impalement: a) 159 Alexander Street, Yonkers, NY - Building C - 1st Floor - Apt 1003: On or about 12/4/23, An employee manually digging in an excavation was exposed to unguarded steel rebar protruding from the floor slab b) 159 Alexander Street, Yonkers, NY - Building C - 1st Floor Residential Hallway: On or about 5/28/24, employees working/walking in this area were exposed unguarded steel rebar that was protruding from the floor slab. c) 159 Alexander Street, Yonkers, NY - Building C - 1st Floor - Inside Apartment 1001: On or about 5/28/24, employees working/walking in this area were not protected against steel rebar protruding from the floor slab. In addition to abatement certification, the employer is required to submit abatement documentation for this item. Failure to comply will result in additional penalty of $ 1,000.00 as per 29 CFR 1903.19.
