29 CFR 1910.178(l)(1)(i):The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l). a. On or about September 27, the employer did not evaluate the competency of employees when they operated powered industrial vehicles such as the Yale forklift, model GLC040, serial number A809N01873 at the worksite. As a result, employees were exposed to struck-by hazards.
