29 CFR 1926.852(b): All materials chutes, or sections thereof, at an angle of more than 45 deg. from the horizontal, shall be entirely enclosed, except for openings equipped with closures at or about floor level for the insertion of materials. The openings shall not exceed 48 inches in height measured along the wall of the chute. At all stories below the top floor, such openings shall be kept closed when not in use. a. Located at the job site located at 1100 Mediterranean Avenue, Columbus, Ohio: On or about June 28, 2023, and at times prior, the employer did not ensure that a materials chute in use from 24-27 feet above the lower level was enclosed and that the chute opening was kept closed when not actively in use. Employees were thereby exposed to struck-by and fall hazards of approximately 24-27 feet.
