29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, is not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. a) 400 Mill Road Wilmington, DE 19806 (Third floor): On or about May 1, 2023, and days prior, multiple trades working over 30 feet above the lower level were exposed to fall hazards when the employer failed to ensure wood framed guardrail systems were properly installed with a top edge height of the top rail 42 inches plus or minus 3 inches. b) 400 Mill Road Wilmington, DE 19806 (fourth floor): On or about May 1, 2023, and days prior, multiple trades working over 30 feet above the lower level were exposed to fall hazards when the employer failed to ensure wood framed guardrail systems were properly installed with a top edge height of the top rail 42 inches plus or minus 3 inches. c) 400 Mill Road Wilmington, DE 19806 (Stairwells): On or about May 1, 2023, and days prior, multiple trades working over 30 feet above the lower level were exposed to fall hazards when the employer failed to ensure a top rail were properly installed with a top edge height of the top rail 42 inches plus or minus 3 inches. d) 400 Mill Road Wilmington, DE 19806 (elevator shaft next to staircase 004): On or about May 1, 2023, and days prior, multiple trades working over 30 feet above the lower level were exposed to fall hazards when the employer failed to ensure a top rail were properly installed with a top edge height of top rail 42 inches plus or minus 3 inches.
