29 CFR 1910.1001(j)(3)(i):Building and facility owners (the employer) did not determine the presence, location, and quantity of ACM and/or PACM at the work site. Employers and building and facility owners shall exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM. a) On or about March 15, 2002, in Building 321, in the warehouse, where asbestos containing material (pipe insulation) was struck by forklifts rendering the material friable, the employer did not determine that the material was asbestos containing. Bulk sample taken during this inspection revealed that the material contained 30 per cent amosite asbestos. b) On or bout March 15, 2022, The employer did not notify the workers of the presence of Asbestos Containing Material (ACM) or Presume Asbestos Containing Material (PACM) was present in the form of pipe insulation in the warehouse. The material became friable when struck by fork truck.
