29 CFR 1910.1053(i)(2): The employer did not make available an initial (baseline) medical examination within 30 days after initial assignment when the employee had not received a medical examination that meets the requirements of this section within the last three years: FOUNDRY: On or about January 21, 2021, an employee was exposed to crystalline silica at a concentration above the action level for 30 or more days per year. He was not provided with a baseline medical evaluation that includes medical and work history, a physical exam with special emphasis on the respiratory system, a chest x-ray, a pulmonary function test, and testing for latent tuberculosis.
