29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems: At a residential construction site located at 2826 SE 8th St, Blue Springs, MO: Employees were exposed to struck-by and caught in hazards. This was demonstrated on or about August 27, 2018 when an employee was permitted to work inside an excavation without any means of protective systems, the use of vibrating equipment next to the edge of the excavation, and active operation of equipment (CAT 416F Backhoe) while the employee was in the excavation. The employer failed to inspect the work area for evidence of hazardous situations.
