Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazard created by forklift tipover. a) Yale forklift being towed from Plant No. 3 to Plant No. 1 repair shop, Yale forklift Model GLP 060RDNURE080, Serial number N 493080: an operator restraint system, or seatbelts, were not provided to protect the operator exposed to a tipover hazard when operating the forklift, on or about 12/05/2000. AMONG OTHER METHODS ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD IS TO INSTALL THE OPERATOR RESTRAINT SYSTEM KIT FOR THE FORKLIFT WHICH WAS RECEIVED FROM THE MANUFACTURER ON AUGUST 7,1991.
