Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The %% employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the following: (a) Employees were allowed by the employer to operate borrowed, specialized all-terrain vehicle(s) without requiring and assuring that the employees read the operator's manual. On or about February 13, 1993, an employee was fatallly injured while operating a 1986 Honda ATC 200X three wheeler. Among other methods, one feasible and acceptable abatement method to correct this hazard is to provide employees access to the Honda Owner's Manufal in order to become familiar with the hazards and safety instructions. Another method would be to follow the guidelines on allterrain vehicles set forth by the Consumer Product Safety Commission.
