29 CFR 1910.146(k)(1)(v): When designating rescue and emergency services pursuant to paragraph 29 CFR 1910.146(d)(9), the employer did not provide the rescue team or service with access to all permit spaces from which rescue may be necessary, so that the rescue service could develop appropriate rescue plans and practice rescue operations: On or about June 12, 2025, and at times thereafter, McKee Utility Contractors, LLC. had not provided a rescue and emergency service with a plan or access to manholes and underground vaults at the workplace prior to entry into those spaces in the following instances listed below: a) On or about June 12, 2025, where one (1) employee was allowed to enter and work in an underground vault; and b) On or about June 13, 2025, where two (2) employees were allowed to enter and work in an underground vault (Vault (53+60)).
