29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area: As referenced in 1910.1052(l)(4) In the alternative: 1910.1052(l)(1): The employer did not provide information and training for each affected employee prior to or at the time of initial assignment to a job involving potential exposure to methylene chloride: a) On or about October 29, 2024 - Kamesi Corporation - 111 E 100th St Apt 2B, New York, NY 10029 Employees performed bathtub refinishing work in a small, windowless bathroom while using hazardous chemicals, including but not limited to Hoodstrip-888 Semi-Paste Remover, which contains 75-90% Methylene Chloride (MC). Exposure to MC can result in serious health risks, including central nervous system depression, unconsciousness, and potentially death through inhalation or skin absorption. The employer did not train the employees on the hazards of the chemicals that they worked with. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000 AS PER 29 CFR 1903.19
