29 CFR 1910.1200(e)(1): Employer had not developed or implemented a written hazard communication program included the requirements outlined in 29 CFR 1910.1200(e)(1)(i) and (e)(1)(ii): a.) Summit Brick - Lakewood Plant site: On or about November 29, 2023, and at times prior, the employer did not establish a hazard communication program. Employees were exposed to chemicals and hazards (such as respirable crystalline silica) at this facility. In fact, OSHA conducted personal exposure sampling on November 29, 2023 and found two employees exposed to 8-hour Time-Weighted Averages over the Action Level of 25 micrograms per cubic meter and the OSHA Permissible Exposure Limit for respirable silica.
