The employer does not utilize procedures to control potentially hazardous energy when employees were engaged in activities covered by 29 CFR 1910.147: 29 CFR 1910.147(c)(4)(i): Procedures were not utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: A recent example of this occurred on 10/25/11 and prior, when: a) In the cream tank alley areas, a Lockout/Tagout(LOTO) procedure was not utilized to isolate Cream Tank # 3's agitator before an employee entered inside of this Permit- Required Confined Space(PRCS). The employee entered inside PRCS Cream Tank # 3 to inspect, install and adjust a spray ball. To abate this violation, the employer shall utilize a Lockout/Tagout(LOTO) procedure to isolate Cream Tank # 3 energy sources. Pursuant to 29 CFR 1903.19(d), the employer must submit documents describing the steps it is taking to ensure compliance, within 30 days of the date it receives this citation.
