29 CFR 1910.146(k)(1)(ii): The employer did not evaluate a prospective rescue service's ability, in terms of proficiency with rescue related tasks and equipment, to function appropriately while rescuing entrants from the particular permit space or types of permit spaces identified. On or about June 12, 2025, and at times thereafter, employees entered permit-required confined spaces at the workplace; the employer did not ensure that the prospective rescue service had been evaluated to determine their ability to provide rescue from permit-spaces maintained onsite (i.e., manholes and underground vaults) in the following instances listed below: a) On or about June 12, 2025, where one (1) employee was allowed to enter and work in an underground vault; and b) On or about June 13, 2025, where two (2) employees were allowed to enter and work in an underground vault (Vault (53+60)).
