29 CFR 1926.1101(h)(2)(i): The employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator: a) Charlotte High School-4115 Lake Avenue, Rochester, NY, Auditorium - On or about December 2, 2024 through December 4, 2024 - the employer failed to implement a respiratory protection program in accordance with 29 CFR 1910.134(b) through (d) [except (d)(1)(iii)], and (f) through (m), which covers each employee required by 29 CFR 1926.1101 to use a respirator when hand scraping of acoustical plaster ceiling which contained 5.8% Chrysotile asbestos, a Class I asbestos job. NO ABATEMENT CERTIFICATION REQUIRED
