29 CFR 1926.1427(f)(1)(ii): Through an evaluation, the employer did not ensure that each operator was qualified by a demonstration of the ability to perform the hoisting activities required for assigned work, including, if applicable, blind lifts, personnel hoisting, and multi-crane lifts: (a)Henry Carlson Construction, LLC at 1508 West 22nd Street, Sioux Falls, SD 57105: On or about and at times prior to May 25, 2023, the controlling employer did not ensure an operator-in-training was qualified to operate the Liebherr 550 HC40, 20-ton tower crane by a demonstration of ability to perform hoisting activities involving personnel. The tower crane operator hoisted employees on a scaffold platform that did not meet the requirements for hoisting employees. During hoisting activities, the platform failed causing two subcontractor employees to fall 40 feet, sustaining serious injuries. This condition exposed employees and subcontracted employees to fall and struck-by hazards.
