29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: On or about September 12, 2022, the employer did not ensure that employees wearing respirators were provided a medical evaluation to determine the employee's ability to use a respirator while working with and around hazardous chemicals, including but not limited to nitric acid, muriatic acid 22deg., hydrochloric acid, copper sulfate, phosphoric acid, 85% ACS, surf-n ammonium sulfate standard grade. This condition exposed employees to nerve and muscle disorders including amyotrophic lateral sclerosis, Guillain-Barre syndrome, and myasthenia gravis, lung and airway diseases such as asthma, cystic fibrosis, COPD, and interstitial lung diseases, fluid buildup in the lungs or pulmonary embolism (a blood clot in your lungs), infections of the brain or spinal cord such as meningitis.
